Q1. What is a patent?

A: A patent is an intellectual property right which is examined and granted by the competent authority (e.g., Patent Office) to an inventor, a utility model creator, or a designer “to exclude others from exploiting the creation without the patentee’s consent” for a limited time period in exchange for public disclosure of the creation when the patent is granted.

Q2. How many types of patents exist in ROC?

A: There are three types of patents, including invention, utility model, and design patent.

Q:For a collaborated patent among faculties and student, who will be entitled for the patent right?

A:Those created patents that are evidently utilize of resources, budget, facility and space on campus, includes patents, technology, product, books and other intellectual property and inherent right, are under the title of Shu-Te University and intellectual right transfer agreement should signed except clearly stated in signed paper otherwise.

 

Q:How to apply subsidy for patent on campus? What is the process?

A:Fill and Submit one paper copy of “Research result patent application form” to the Intellectual Property Office before the deadline, and e-mail electronic format to: mutze@stu.edu.tw. Once it’s been approved by “Patent evaluate team” related patent fee will be paid by the school. Some partial fees that are subsidized by other institutes out of campus will be deducted in advance.

 

Q:For a joint effort patent technology, who will be in charge of applying subsidy?

A:All patents that created on campus and apply for grant are under the title of ”Shu-Te University” and co-signed by inventors or creators. Once the inventor or creator is more than one, a representative should be assigned to fully in charge of such issues as patent application, maintenance, benefit distribution (include technology transfer).
